Abbey Spanier serves as co-counsel in a derivative action in the Delaware Chancery Court. Plaintiffs allege that Marsh & McLennan's officers and directors breached their fiduciary duty by engaging in a scheme involving secret agreements and bid-rigging in order to steer business to certain insurance companies in exchange for kick-back commissions. Defendants' actions caused the Company to suffer billions of dollars in damages. On June 17, 2009, plaintiffs defeated a motion to dismiss. Discovery is currently ongoing.
