ABBEY SPANIER RODD & ABRAMS, LLP FILES CLASS ACTION ON BEHALF OF HOME HEALTH CARE WORKERS Abbey Spanier Rodd & Abrams, LLP, MFY Legal Services, Inc. and National Employment Law Project have filed a class action on behalf of employees who work or have worked as home health care workers for McMillan's Home Health Care Agency, Inc. The case was filed in the Supreme Court of the State of New York, County of New York (Index No.10104779). The Complaint alleges that Plaintiff and the class she seeks to represent were consistently underpaid, and never paid overtime, despite frequently working upwards of 60 hours per week. The Complaint, which additionally charges that McMillan's unlawfully required workers to cover the costs of cleaning their uniforms and purchasing certain supplies and repeatedly falsified or misreported pay records, seeks unpaid wages and assurance that the company will comply with New York State's wage and hour laws in the future. Working in one of the nation's fastest-growing occupations, Plaintiff and the Class provide crucial care for elderly, infirm and homebound patients in and around New York City. Home care workers make up one of every seven low wage workers in New York City. Home care workers are often poorly paid, many earning only the minimum wage or a few cents more for jobs that require long hours, dedication and hard work. |
