ABBEY SPANIER RODD & ABRAMS, LLP FILE AGE DISCRIMINATION SUIT AGAINST QUEST DIAGNOSTICS, INC.

Abbey Spanier Rodd & Abrams, LLP, and Green Savits & Lenzo, LLC, filed a class action lawsuit on behalf of a class of individuals who were part of the Quest Diagnostics, Inc. (NYSE: DGX) sales force and who were fired or resigned from the company while on performance improvement plans ("PIP") or after being advised that they would be put on a PIP. The class period begins on November 18, 2008.

The complaint, filed in the Superior Court of New Jersey, Essex County, alleges that the company determined to restructure its sales force by "managing out" older employees, many of whom had been with Quest Diagnostics for decades and had established long-standing relationships with the company's customers, to make way for a "Ken and Barbie" sales force, consisting of younger employees with less experience. The claims for age discrimination are brought pursuant to the New Jersey Law Against Discrimination.

The defendants are Quest Diagnostics Inc., headquartered in New Jersey, and three individual executives who plaintiff believes devised and implemented this discriminatory policy. Quest Diagnostics is a leading provider of diagnostic testing, information and services. The individual defendants are Surya N. Mohapatra, Chairman of Quest Diagnostics' Board of Directors, President and Chief Executive Officer; John Nosenzo, former Vice President of Sales and Marketing; and Tom Schoenherr, a Regional Vice President of Sales.
