New York Road Runners Litigation
In January and February, 2016, two class actions were commenced against Defendant, New York Road Runners (“NYRR”), in the United States District Court for the Southern District of New York, alleging that NYRR conducted unlawful lotteries for entry into the New York Marathon (the “Marathon”) and the New York City Half Marathon (the “Half Marathon”). The two class actions were consolidated, and the Plaintiffs filed a Consolidated Class Action Complaint on March 25, 2016. Click here to see the Consolidated Class Action Complaint
On September 9, 2016, the parties executed a Settlement Stipulation, which provides: (i) race credits to eligible Settlement Class Members for Entry Fees in certain future NYRR races valued at approximately $2.1 million for all the available credits; (ii) an agreement by NYRR not to charge drawing or processing fees or apply for a license to conduct a lottery for entry into any of its races for at least the next three years, valued at approximately $3.1 million; (iii) an agreement by NYRR to make disclosures regarding the entry process for the Marathon and Half-Marathon; and (iv) a charitable contribution by NYRR of $100,000 to the New York City Parks Foundation. On September 15, 2016, the Court preliminary approved the proposed settlement. Pursuant to the preliminary approval order the Court certified for settlement purposes only, the Settlement Class, consisting of:
All persons residing in the United States and territories of the United States who: (i) sought “non-guaranteed entry” by entering the drawing conducted by Defendant for each of the Covered Races, and/or (ii) received “guaranteed entry” through one of Defendant’s “Official Charity Partners” for each of the Covered Races.
