ABBEY SPANIER RODD & ABRAMS, LLP FILES NATIONAL CLASS ACTION AGAINST TOYOTA MOTOR CORPORATION BASED ON SUDDEN ACCELERATION DEFECT
February 8, 2010 - Abbey Spanier Rodd & Abrams, LLP filed a nationwide class action lawsuit against Toyota Motor Corporation. ("Toyota") and certain affiliated entities in the United States District Court for the Southern District of New York on behalf of Toyota vehicle owners and lessees based on the faulty accelerator pedal assemblies and floor mats which resulted in Toyota's recent recall of millions of vehicles in the United States. The recall served as an admission of wide-ranging problems with sudden, dangerous acceleration in multiple models of Toyota's cars and trucks which have resulted in injuries and deaths. The recall is in addition to the previously announced risk that the accelerator pedals could become entrapped by loose or improperly installed floor mats.

As recently as November, Toyota's U.S. brand chief said there was "no evidence" to support claims that the reported safety problems could be caused by anything other than loose floor mats interfering with the accelerator pedal. The lawsuit seeks, among other forms of relief, that Toyota make class members' car and lease payments until the defects are resolved and compensation for the diminished value of the cars that resulted once the Toyota's defects became known.

The approximately 5.3 vehicles covered by the floor pedal entrapment recall include the following:

2009 to 2010 model year ("MY") Pontiac Vibe;
2005 to 2010 MY Toyota Avalon;
2007 to 2010 MY Toyota Camry;
2009 to 2010 MY Toyota Corolla;
2008 to 2010 MY Toyota Highlander;
2009 to 2010 MY Toyota Matrix;
2004 to 2009 MY Toyota Prius;
2005 to 2010 MY Toyota Tacoma;
2007 to 2010 MY Toyota Tundra;
2009 to 2010 MY Toyota Venza;
2007 to 2010 MY Lexus ES 350;
2006 to 2010 MY Lexus IS 250; and
2006 to 2010 MY Lexus IS 350.

The approximately 2.3 million vehicles affected by the defective accelerator pedal assemblies include:

2005 to 2010 MY Toyota Avalon;
certain 2009 to 2010 MY Toyota Corolla;
certain 2007 to 2010 MY Toyota Camry;
2010 MY Toyota Highlander;
2009 to 2010 MY Toyota Matrix;
certain 2009 to 2010 MY Toyota RAV4;
2008 to 2010 MY Toyota Sequoia; and
2007 to 2010 MY Toyota Tundra.
